Welcome to Suivi. These Terms of Service ("Terms") explain how you may use our parcel delivery platform (the "Service"), what we expect from you, and what you can expect from us. Please read them—by using Suivi you agree to these Terms and our Privacy Policy.
1. Who we are & acceptance
1.1 Provider: Suivi Ltd. ("Suivi", "we", "us") provides a platform that connects senders and riders for pickup and delivery services.
1.2 Acceptance: By downloading, registering, or using the Service you accept these Terms and our Privacy Policy. If you do not agree, don't use the Service.
2. Accounts & access
2.1 Account creation: You must create an account with accurate information. You're responsible for keeping credentials secure.
2.2 Eligibility: You must be legally able to enter into contracts in your jurisdiction and meet any rider-specific requirements (licenses, vehicle registration).
2.3 Account conduct: You agree not to misuse the Service (no fraud, no impersonation, no harassment). We may suspend or terminate accounts for violations.
3. Using the Service
3.1 Core functions: Suivi enables requesting pickups, accepting delivery tasks (for riders), live tracking, payments, and in-app communication.
3.2 User responsibilities: Senders must provide accurate delivery details and lawful items. Riders must follow local laws, use safe driving practices, and follow instructions when accepting assignments.
3.3 Payments & fees: Prices, commissions, and payment terms are shown in-app. You agree to pay applicable fees. Riders receive payouts per their rider agreement. Payment processing may have separate terms.
4. Content, IP & rights
4.1 Our content: Suivi owns the app, branding, and software—you get a limited, revocable license to use it.
4.2 Your content: Messages, images, and other content you upload remain yours, but you grant Suivi a license to use them to provide the Service (for example, to display a proof of delivery).
4.3 Feedback: If you give product feedback, you grant us a perpetual, royalty-free right to use it.
5. Disclaimers & limits of liability
5.1 No guarantee: While we design for reliability, the Service is provided "as is." We do not guarantee uninterrupted service or perfect outcomes.
5.2 Limits: To the maximum extent permitted by law, Suivi's liability for direct damages is limited to amounts you paid us in the prior 12 months. We are not liable for indirect, special, or punitive damages.
6. Suspension, termination & refunds
6.1 Our rights: We may suspend or terminate access for violations, safety concerns, or legal reasons.
6.2 Your rights: You may close your account at any time; certain records may be retained as required by law. Refunds are handled per our refund policy and in-app terms.
7. Disputes, governing law & changes
7.1 Governing law: These Terms are governed by the laws of the jurisdiction where Suivi is incorporated, Nairobi Kenya.
7.2 Changes: We may update these Terms. Substantive changes will be posted in the app and, where appropriate, notified to users. Continued use after notice means you accept the changes.
